General conditions of use of the application to view scores

Instituto Complutense de Ciencias Musicales (hereinafter, ICCMU) offers, through its platform, the service called "Base de datos del corpus de arias del Proyecto Didone con visualización en streaming", through which users can view scores online in digital format with page scrolling or “scrolling” (hereinafter, the Service and/or its contents).

The Service and its contents are offered by ICCMU under the following terms and conditions:

  1. Internet Connection: to use the Service, the user must have access to the Internet and a device compatible with the Service itself.

  2. Subscription: to use the Service and/or its contents the user must be duly registered.

  3. Territorial scope: the Service and/or its contents can be accessed from the anywhere in the world.

  4. Personal and private use: the Service and/or its contents are exclusively for personal and private use, and cannot be used for public interpretation or for marketing or transmission to third parties.

    In the event that a user is interested in accessing the score for venal use or within an event for interpretation, they must direct their request to the email address contacto@iccmu.es, specifying the applicant's data, as well as the object and purpose of the request. ICCMU will deal with your request as soon as possible.

  5. Prohibition of downloading, reproduction and/or distribution: the contents accessed through the Service can only be viewed online (“streaming”) through the ICCMU platform, and their downloading, reproduction (by any means, including but not limited to photography, printing, audiovisual recording, image capture) and/or distribution is strictly prohibited.

  6. Prohibition of modification, alteration, manipulation or adaptation: it is strictly prohibited to carry out any modification, alteration, manipulation or adaptation of the Service and/or its contents.

  7. Other prohibitions: the following is strictly prohibited:

    1. circumvent, remove, alter, deactivate, downgrade, block, obscure or defeat any security or protection measures of the Service and/or its contents;

    2. use any type of means to access the Service and/or its contents without authorization;

    3. decompile, reverse engineer or disassemble any software accessible from the Service;

    4. use any data mining, data collection or extraction methods;

    5. transmit by any means material designed to interrupt, destroy or limit the functionality of the Service, including any computer viruses or other computer code, files or programs.

    6. use the Service and/or its contents for illegal, unlawful or fraudulent activities or purposes or for purposes other than those authorized in these Conditions; either

    7. remove, delete or obscure any notice, copyright recognitions, logos or warnings incorporated in the Service and/or its contents.

  8. Suspension, limitation, restriction and refusal of use: CCMU reserves the right to suspend, limit, restrict or refuse the use of the Services and/or contents without prior notice, at its own request or at the request of a third party, to those users who fail to comply or act in contravention of any of these Conditions.

    Likewise, ICCMU reserves the right to pursue non-compliance with these Conditions, as well as any improper use of its Services and/or content by exercising all civil, administrative and criminal actions that may correspond to it by law.

  9. Quality of the Service and/or its contents: the quality of the Service and/or its contents may vary depending on the device from which it is accessed, and may be affected by various factors, such as location, available bandwidth and/or the speed of the Internet connection. ICCMU is not responsible for any of the aspects referred to, nor for any incidents, errors or delays in connectivity or in access to the Service and/or content that may occur due to causes that are not attributable to ICCMU or that are attributable to third parties.

  10. Password and account access: the password to access the Service and/or its contents is only for the user's personal use and must not be revealed to anyone. If the user allows others to access his/her password and account, he/she is responsible for any damage or loss that this breach may cause and exempt ICCMU from all liability.   11. Subsistence: If any provision or provisions of these Conditions are declared invalid, illegal or ineffective, the validity, legality and effectiveness of the remaining provisions shall remain in force and with full effect.

  12. Intellectual and industrial property: ICCMU is the owner or, where applicable, licensee of all intellectual and industrial property rights over its Service and/or contents. Consequently, its reproduction, distribution, public communication, including its modality of making available, and its transformation are expressly prohibited.

  13. Changes in the General Conditions of use: ICCMU may modify the conditions determined here at any time, being duly published as they appear here. The validity of the aforementioned conditions will depend on their exposure and will be in force until they are modified by others duly published.

  14. Applicable legislation and jurisdiction: The relationship between ICCMU and the user will be governed by current Spanish regulations. When the applicable legislation allows the parties to choose the jurisdiction, the parties, expressly waiving any other jurisdiction that may apply to them, agree to submit the knowledge of any divergences that may arise from the interpretation or non - application of these conditions to the Courts and Tribunals of the city of Madrid, without prejudice to the right of whoever acts as a consumer to claim before the courts of their domicile.

Instituto Complutense de Ciencias Musicales (hereinafter, ICCMU) in accordance with current legislation on the protection of personal data - Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights and General Data Protection Regulation - informs users of the website http://arias.didone.eu (hereinafter, the website) on the Privacy Policy that applies to the processing of personal data that you voluntarily provide through the enabled forms.

Data Controller

The personal data collected through this website are included in the files, the controller of which is the Instituto Complutense de Ciencias Musicales (ICCMU), with address for these purposes at C/Profesor Aranguren, s/n, 28040 Madrid (Facultad de Geografía e Historia de la Universidad Complutense de Madrid, Edificio de Fislosofía B) and with contact email: contacto@iccmu.es.

Treatment purposes

The aforementioned data will be used to allow the user access to the service called "Base de datos del corpus de arias del Proyecto Didone con visualización en streaming", through which you can view scores online in digital format with page scrolling.

It is necessary to provide the requested personal data, so that ICCMU can provide the expressed service to the user. Otherwise, the user will not be able to access the expressed service.

The data will be used exclusively by ICCMU or by the company or professional that may be contracted to carry out, on demand, the provision of the aforementioned service.

The basis for the processing of personal data is the consent given by the user by filling in the corresponding form, ticking the acceptance box and voluntarily submitting their data.

The data provided will be kept for as long as the professional or commercial relationship is maintained, as well as for all the years necessary to comply with legal obligations.

The data will not be transferred or communicated to third parties, except in the cases necessary for the fulfillment and execution of contractual relationships and/or for compliance with legally established obligations and/or when they are claimed by any administrative or judicial authority.

Rights of the interested party

In any case, the data subject may exercise his or her rights of access to the aforementioned data, rectification of those that are inaccurate, erasure, when they are not necessary for the purposes for which they were collected, objection, limitation and portability to ICCMU, through written communication to the email address contacto@iccmu.es providing a photocopy of your CIF, DNI or equivalent document and identifying the right requested.

Likewise, if you consider your right to the protection of personal data has been violated, you may lodge a clomplaint with the Spanish Data Protection Agency (www.aepd.es).

The owner of the data is solely responsible for the veracity, accuracy and updating of the data provided, as well as for any damages that may arise from failure to comply with the aforementioned obligation.

Technical and organizational measures

Personal data will be stored and managed by applying the IT security measures established in the applicable legislation to prevent unauthorized access or improper use, manipulation, deterioration or loss, as well as to safeguard its confidentiality.
